A US trade court has delivered a significant blow to President Trump’s tariff regime, ruling it illegal. However, an appeals court has provided a temporary stay on that decision, giving the administration a chance to fight back. This legal maneuvering highlights the ongoing struggle over the extent of presidential power in matters of trade and national security.
The Court of International Trade found that Trump’s tariff orders “exceed any authority granted to the president,” particularly in his use of the International Emergency Economic Powers Act (IEEPA) to bypass congressional approval. The court made it clear that its ruling was about the legality of the tariffs, not their economic wisdom.
The Trump administration has been quick to condemn the judiciary, with White House press secretary Karoline Leavitt stating that the judges “brazenly abused their judicial power.” This legal battle, which could potentially reach the Supreme Court, will have lasting implications for the balance of power between the executive and judicial branches.
