The Trump administration’s recent actions, including the release of contentious election-related documents and reiterated claims about noncitizen voting, have sparked concerns among voting experts about potential federal intervention in the upcoming November midterm elections. President Trump has persistently alleged that U.S. elections are susceptible to foreign interference and has reiterated baseless claims that the 2020 presidential election was rigged. Notably, former adviser Steve Bannon has suggested that Trump might declare a national security emergency concerning the elections.

Despite these assertions, legal experts emphasize that a national emergency declaration would not circumvent constitutional restraints on presidential authority over election administration. Historically, no U.S. president has utilized emergency powers to assume control over elections. This underscores the significant legal and constitutional challenges that would accompany any such attempt by the administration.

The administration has also been proactive in disseminating declassified information regarding voting machines, foreign influence, and voter registration processes. Alongside this, they have promoted contentious analyses concerning noncitizen voting. Critics of these actions argue that some claims are made without adequate methodological transparency and could be exploited to justify increased federal oversight over state-managed elections.

The White House has not dismissed the possibility of taking emergency action, while continuing to back legislative measures aimed at enhancing federal involvement in voter registration and electoral procedures. The blending of these legislative pursuits with the administration’s rhetoric and actions has raised alarms about the potential for expanding federal influence over a domain traditionally managed by state and local authorities.
